EP IMCO heard back from the first trilogue on the transparency and targeting of political advertising
On 1 March, the EP IMCO Committee reported on the first round of trilogue negotiations on the Transparency and Targeting of Political Advertising file, which were held on 28 February.
The Rapporteur underlined that the debate was positive and constructive. Co-legislators presented their positions, which were aligned on the key proposal objectives. LIBE Rapporteur Anna Donath, also participated in the trilogue meeting, which included a discussion on Article 12 (Specific requirements related to targeting and amplification).
On IMCO responsibilities, Sandro Gozi highlighted the ban on third country sponsors, labelling, streamlining obligations for all actors, the creation of a single repository for online political advertisements, reinforcing the notification procedure for potentially unlawful ads, and enhancing the enforcement and governance structure.
DIGITAL SERVICES ACT
Commission publishes a call for feedback on the DSA draft Implementing Regulation
Last month, the European Commission announced a call for feedback on the Digital Services Act (DSA) draft implementing regulation, which came into effect on 16 November, with the purpose of making a safer and more accountable online environment. The deadline to respond is 16 March.
In addition, 17 February was the deadline under the DSA framework for all online platforms and online search engines to notify the Commission of their user numbers. This data will be used to determine whether providers classify as VLOPs or VLOSEs, as required by the DSA.
The Commission also published non-binding guidance on the DSA framework to help online platforms understand their obligations.

EP LIBE publishes draft motion on the adequacy of the protection afforded by the EU-US Data Privacy Framework
On 14 February, the EP LIBE Committee published its draft motion for the resolution to conclude the debate on the adequacy of the protection, afforded by the EU-US Data Privacy Framework.
Rapporteur MEP López Aguilar (S&D) underlined that the EP encouraged the Commission to avoid any new US adequacy decisions, except for the introduction of meaningful reforms. The Committee concluded that the EU-US Data Privacy Framework failed to create actual equivalence in the level of protection. MEP López Aguilar (S&D) also underlined that the draft motion focused on the fundamental right of data protection against indiscriminate mass surveillance, in the absence of an adequate remedy. He stressed that the Commission proposal did not meet the minimum standards required by GDPR, and would contravene Court rulings.
EDPB Chair, Andrea Jelinek, presented the Board’s opinion, which focused on one key goal: guaranteeing sufficient protection to EU citizens in the event that their data is transferred to the US. In the text, the EDPB made the distinction between commercial aspects, and governmental access and use of personal data. Overall, the Board welcomed the improvements in the draft adequacy decision, but they also expressed concerns on the following areas: certain rights of data subjects, onward transfers, the scope of exemptions, temporary bulk collection of data and the practical functioning of the redress mechanism.
CULTURAL AND CREATIVE SECTORS AND INDUSTRIES ROUNDTABLE
Commissioner Gabriel hosts first roundtable with representatives of the cultural and creative sectors
On 21 February, Commissioner Gabriel presented the first of three roundtables with selected high-level representatives from the cultural and creative sectors and industries.
Firstly, the Commissioner aimed to reinforce the ecosystem of cultural and creative sectors and industries, through the outlined initiatives. In addition, the Commissioner sought to promote a direct link between the industry and the Commission, e.g., participants requested more networking opportunities, inclusion of rural areas and small realities, and for a new strategic vision for a pan-European cultural policy.
The next roundtables are scheduled for April and June 2023.
